Welcome to SkyWise, provided by Modrn Magic LLC ("we," "us," "our"). By accessing or using our weather service app ("Service"), you ("you," "your," or "User") agree to be bound by these Terms of Service ("Terms").

Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

Changes to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any such changes indicates your acceptance of the new Terms.

Subscription Details

Pro Plan

SkyWise offers a Pro plan subscription that provides enhanced features, including more calls to the GPT assistant, no advertisements, and access to additional UI features. The Pro plan is available through a monthly subscription.

Payments and Renewals

Subscriptions are managed and processed by RevenueCat. By subscribing to the Pro plan, you agree to the payment terms as specified at the time of purchase. Subscriptions automatically renew each month unless cancelled at least 24 hours before the end of the current subscription period.

Cancellations

You can manage or cancel your subscription through your account settings with the app store from which you originally purchased the subscription.

Advertisements

The free version of the Service may display advertisements provided by Google Ads. These advertisements are targeted and delivered by Google, and we do not control the content or frequency of these ads. The Pro plan does not display these advertisements.

User Data and Firebase

We use Firebase to store user account details, such as the number of messages sent to the GPT assistant. This data is used to manage your account and improve the Service. Your use of the Service constitutes your consent to this data collection and use as outlined in our Privacy Policy.

Intellectual Property

The Service, including the text, graphics, images, and information provided by the AI assistant, is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use only.

User Feedback

We welcome your feedback, comments, and suggestions. By submitting feedback, you grant us the right to use it without any restriction or compensation to you.

Accuracy of Information and Disclaimer of Warranty

Weather Predictions and Data

The Service relies on data from the National Oceanic and Atmospheric Administration (NOAA) API to provide weather forecasts and related information. While NOAA is a reputable source for weather data, weather conditions are dynamic and subject to sudden changes. Therefore, we cannot guarantee the accuracy, completeness, reliability, or timeliness of the weather information provided through the Service.

AI Assistant Responses

The AI-powered assistant in SkyWise aims to provide helpful responses based on your queries. Despite our efforts for accuracy, the responses are based on available data and may not always be correct. Use discretion and verify information through additional sources when making critical decisions.

Limitation of Liability

We shall not be liable for any damages arising from your use of the Service or reliance on the information provided through it. This includes inaccuracies in weather forecasts or assistant responses.

Updates and Maintenance

We may update the Service to enhance functionality and user experience. This might result in temporary downtime, for which we aim to minimize disruption.

User Accounts and Security

You are responsible for maintaining the confidentiality of your account information and for all activities under your account.

Termination and Suspension

We reserve the right to terminate or suspend your access for violations of these Terms, illegal activities, or other misconduct.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Hawaii. Disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Hawaii.

Modifications to the Service

We may modify or discontinue the Service or any part thereof without notice. We are not liable for any modification, suspension, or discontinuance.
